Description

The fundamentals of all Australian civil jurisdictions are substantially the same but each jurisdiction is still unique and has its own particular characteristics.

This book by Bernard Cairns, the well-regarded author of Australian Civil Procedure, puts the fundamentals of the civil litigation system into a Queensland context.

Principles of Civil Procedure in Queensland is intended for students studying civil procedure or civil litigation. All topics prescribed for Civil Procedure for admission as a legal practitioner in Queensland are included in this book.

Developments since the first edition:

o Class actions would need greater attention as Queensland has introduced class actions since previous edition was published. It follows the Federal scheme.

o The growing scope of the QCAT’s functions makes for an important contrast with the formalities of civil court procedure.

o Review of the course content by the Law Admissions Consultative Committee (LACC) favours a more policy-based approach, for example access to justice, cost and other barriers impeding access to the justice system.
