A custom compilation of three chapters written by Dr Sheelagh McCracken, Professor of Finance Law at the University of Sydney. Two chapters have been extracted from Everett and McCracken's Banking and Financial Institutions Law 9e, and one chapter from Commercial Law: Commentary and Materials 4e.
Chapter 1 offers an analysis of how the regime works through detailed commentary. By contrast, Chapter 2 provides edited extracts from the Australian case law, with the accompanying commentary seeking primarily to set those cases in context. Chapter 3 complements Chapters 1 and 2 through its analysis of the general forms of security recognised under general law: the mortgage, the charge and the pledge which arise consensually, and the common law possessory lien which arises by operation of law.
The three chapters are brought together to support teaching of undergraduate and postgraduate courses on secured transactions law, and may also provide practitioners with some insights into the operation of the PPSA and its critical role within the modern Australian commercial law landscape.
