Description

To cope with stark challenges such as concentrated markets, cost of living pressures, the entrenched power of the digital juggernauts and shifting business practices, Australian competition law is being forced to adapt. In this volume, more than twenty experts in competition law, economics and policy come together to discuss fundamental principles, current problems, and the evolving design of the law in this field.  

In a period of profound change, and against the background of legislative revisions and case law developments, the authors consider today’s pressing issues while putting reforms in their legal and economic context. The book is divided into an Introduction and seven Parts. The Introduction and Part I lay out the key principles of Australian competition law, its economic foundations, and the essential competition provisions established in the (amended) Competition and Consumer Act. Part II presents the elaborate merger system that took full effect in 2026. Economic experts then discuss various approaches to the analysis of the competitive effects of different types of mergers. Part III discusses the latest case law developments in the field of misuse of market power, as well as price-based and non-price vertical restraints. Part IV discusses the legal frameworks and evolving case practice relating to restrictive contracts, arrangements, and understandings, including the cartel prohibitions and their exceptions. Part V provides a detailed discussion of the authorisation and notification procedures. Part VI focuses on specific themes, namely: access regulation; digital platforms, the role of data, transformations in the field of logistics, and challenges posed by artificial intelligence; and the interplay between competition act and intellectual property. Part VII concludes the book with chapters on the public enforcement and private enforcement of Australian competition law. Together these eighteen chapters present a sweeping analysis of this complex, dynamic field. The book will assist lawyers, educators, law students, decision makers, shapers of policy and interested researchers from other disciplines.
