Mann’s Annotated Insurance Contracts Act, 10th edition is a very special edition. The authors have included, for the first time, an annotation of the Life Insurance Act 1995 (Cth). This comprehensive annotation of the Life Insurance Act provides commentary and guidance on contentious issues aided by background material, some of which is difficult to find. An annotation by the authors of the Life Insurance Act has only previously been available to Westlaw subscribers to Mann’s Annotated Insurance Law. 

This 10th edition continues to provide the full text of the Insurance Contracts Act 1984 (Cth) and Insurance Contracts Regulations 2017 (Cth) accompanied by clear, concise and wide-ranging annotations helpfully explaining the operation of the Act and Regulations. The book’s utility has continued to grow incrementally through each successive edition with its commentary that explains the relevant cases which are increasing in number, and some with increased complexity, and the numerous amendments to the Insurance Contracts Act, particularly in more recent years.

The Life Insurance Act contains (among other things) provisions relating to policies which operate alongside the Insurance Contracts Act . The commentary on the Life Insurance Act includes expansive discussion of the controversial question of whether cancellation of a life policy by the insurer for non-payment of premium is governed by the cancellation procedure in section 210(5) of the Life Insurance Act or section 59 of the Insurance Contracts Act . Also included is commentary on the further controversial question of whether a declaration by the Australian Prudential Regulation Authority under section 12A of the Life Insurance Act is required to lawfully include general insurance covers together with life insurance covers in a single policy, where the life company is the sole insurer of all the covers.

This book also contains commentary on the unfair contact terms regime in Subdiv BA of Div 2 of Pt 2 of the of the Australian Securities and Investments Commission Act 2001 (Cth) in so far as it applies to, or is relevant to, insurance contracts. Since 9 November 2023 this regime has included civil penalty provisions. The Court also has power to vary the insurance contact.

This book also contains commentary on the obligation of an Australian financial services licensee to do all things necessary to ensure that the financial services covered by the licence are provided “efficiently, honestly and fairly”, under section 912A(1)(a) of the Corporations Act 2001 (Cth), in so far as this obligation applies to, or is relevant to, insurance contracts. The obligation is relevant to Australian insurers, as they are generally required to hold an Australian financial services licence. There is a very large overlap between an insurer’s duty of utmost good faith and its obligation to provide the financial services efficiently, honestly and fairly. Prima facie, a failure by an insurer to act with the utmost good faith is also a failure to provide the financial services efficiently, honestly and fairly, which may attract a substantial penalty.

Mann’s 10th edition is an essential publication for all insurance lawyers, insurance professionals including underwriters, claims managers, insurance brokers, loss adjusters, academics and students. The title provides a practical guide to the Insurance Contracts Act and related legislation with annotations.
