This volume takes selected legislation and commentary from Thomson Reuters’ NSW Civil Practice and Procedure service which, under the guidance of The Hon John P Hamilton KC, The Hon Justice Geoff Lindsay AM and Carol Webster SC, addresses the requirements for practice within the framework of the Civil Procedure Act and Uniform Rules.
NEW DEVELOPMENTS OVER THE LAST 12 MONTHS
These include new and updated Practice Notes issued in 2025 and 2026 by the Supreme Court of NSW and District Court of NSW:
- New Practice Note SC Eq 15, Applications List sets out procedures for the hearing of motions in the Applications List
- Revised Practice Note SC Eq 10, Revenue List sets out changed procedures for matters in the Revenue List (that is, where the Commissioner of Taxation or Chief Commissioner of State revenue is a party, or an issue arises under a law under which the Commissioners exercise functions)
- New Practice Note DC Civil PN 16, Case Management in the General List replaced former DC (Civil) No 1
- New Practice Note DC Civil PN 17 Defamation List replaced former District Court Civil Practice Note No 6
Commentary has been updated to include recent Court of Appeal and High Court of Australia decisions such as:
- Lendlease Corporation Ltd v Pallas [2025] HCA 19 in which the High Court considered CPA s 175(5) and “soft closure,” allowing an appeal from Pallas v Lendlease Corporation Ltd [2024] NSWCA 83 (a five-judge Court of Appeal)
- Kain v R&B Investments Pty Ltd; Ernst & Young (A Firm) v R&B Investments Pty Ltd; Shand v R&B Investments Pty Ltd [2025] HCA 28 where the High Court held that there is power under equivalent Federal Court Act provisions for Settlement CFOs and Judgment CFOs in favour of litigation funders, but where contingency fees are not permitted a CFO in favour of a solicitor would not be ‘just’ or within power
- Daracon Engineering Pty Ltd v Kelsall [2025] NSWCA 189 where the Court considered when leave might be granted under UCPR 7.1 for a party to have separate sets of representation
- Yufeng Investment Group (Australia) Pty Ltd v Guo [2026] NSWCA 3 which considered UCPR 12.6(2) regarding the need for consent or leave of the court to withdraw an admission in a defence, the rule does not apply to a statement of claim (or Commercial List statement)
- Allchin v Hunter Water Corporation [2025] NSWCA 253 which clarified that a trial may be “called on” for the purposes of UCPR 29.7 more than once during a hearing
Mende v Kundrun [2026] NSWCA 1 regarding parties who should be joined to proceedings in the Court of Appeal.
